INTELLECTUAL PROPERTY LAW

Intellectual Property Law is regulated under the Law numbered 5846 on Intellectual and Artistic Works and the Law numbered 6769 on Industrial Property as well as the international treaties to which Turkey is a party. IP Law consists of two components including copyrights and industrial properties.
Copyrights originate autogenously along with the production of artistic work. Protection commences with the publicization of the work. A notification or registration procedure is not required for the provision of protection. Still, discretional registration before Turkish Directorate General for Copyright is recommended to provide confidence in case of a future dispute. On the other hand, in Industrial Property rights the relevant invention, design, trademark should be registered before Turkish patent and Trademark authority for protection purposes.
